By using our website, submitting an enquiry, or engaging our legal services, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the website or our services.

You must be at least 18 years of age and have full legal capacity to enter into a binding agreement to engage our services. Individuals under 18 may only be clients if represented by a parent or legal guardian.

Saengchan provides family legal services in Thailand, primarily to clients in Songkhla and surrounding southern provinces. Our services include:

All services are delivered by, or under the direct supervision of, lawyers licensed with the Lawyers Council of Thailand. Services are available in Thai and English.

4. Engagement and Service Delivery

Each engagement begins with an initial consultation. Following this, if both parties wish to proceed, we will issue an Engagement Agreement setting out the scope of work, fees, and expected timeline. No substantial legal work is undertaken until the Engagement Agreement is signed and the agreed initial payment is received.

We will use reasonable professional skill and care in delivering services. Timelines are estimates based on the nature of the matter and may be affected by third-party factors including court schedules, government department processing times, and the conduct of opposing parties.

Our fees are fixed per service as quoted in the Engagement Agreement. Current indicative fees are:

Additional work beyond the agreed scope — such as court hearings not included in the initial quote — will be agreed in writing before being undertaken. Payment is accepted in Thai Baht (THB) via cash or bank transfer. Fees quoted do not include court filing fees, government charges, or third-party costs, which are charged at cost.

Fees paid are not refundable once work on the agreed scope has commenced, except where Saengchan is unable to complete the engagement for reasons within our control.

7. Confidentiality

We are bound by professional confidentiality obligations under Thai legal professional standards. All information shared with us in the context of a legal matter will be treated as strictly confidential and will not be disclosed to third parties except as required by law, ordered by a court, or with your express written consent.

8. Intellectual Property

All content on our website — including text, design, layout, and graphics — is the property of Saengchan or its licensors and is protected under applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from this content without our written permission.

Legal documents and correspondence produced specifically for your matter remain your property once fees have been settled in full.

9. Disclaimers

We provide legal services with professional care. However, we cannot and do not warrant specific outcomes in legal matters. Family law proceedings involve court discretion, third-party conduct, and other factors outside our control.

Information on our website is provided for general informational purposes only and does not constitute legal advice. Specific legal advice is only given in the context of a formal engagement.

10. Limitation of Liability

To the extent permitted by Thai law, Saengchan's liability for any claim arising from our services is limited to the total fees paid by the client for the specific matter to which the claim relates. We are not liable for indirect, consequential, or special damages.

We are not liable for delays or failures in performance resulting from circumstances outside our reasonable control, including court delays, government processing times, or the actions of third parties.

11. Indemnification

You agree to indemnify and hold Saengchan harmless from any claims, damages, or costs arising from your provision of inaccurate or misleading information, your breach of these terms, or your conduct in the course of any matter we handle on your behalf.

12. Termination

Either party may terminate an engagement by providing written notice. You may terminate at any time. We may terminate if you breach the Engagement Agreement, fail to provide required information, or fail to make payment. On termination, fees are due for all work completed up to the termination date. We will return original documents to you promptly.

Clauses relating to confidentiality, payment, intellectual property, and dispute resolution survive termination of any engagement.

13. Dispute Resolution

These Terms & Conditions are governed by the laws of Thailand. If a dispute arises in connection with these terms or our services, the parties agree to first attempt resolution through direct negotiation. If unresolved within 30 days, the dispute may be referred to mediation before either party pursues litigation. Any legal proceedings shall be conducted in the courts of Songkhla Province, Thailand.

14. General Provisions

These Terms & Conditions, together with any signed Engagement Agreement, constitute the entire agreement between Saengchan and the Client in respect of the engagement. If any provision is found to be unenforceable, it shall be modified to the minimum extent necessary and the remaining provisions shall continue in full force. No waiver of any term shall constitute a continuing waiver.

15. Changes to These Terms

We may revise these Terms & Conditions from time to time. The current version will always be published on our website. For existing clients, material changes will be communicated by email. Continued use of our website or services after a revision constitutes acceptance.
